General information on the implementation of the data protection requirements of Article 13 of the General Data Protection Regulation (GDPR)

I. Introduction

Under its articles of association, Trinkwasserwald e.V. has the task of making an important contribution to securing quality of life through ecologically appropriate tree planting. The goals of the ‚Earth Summit‘ in Rio de Janeiro in 1992 and the national goal of the Federal Republic of Germany to achieve a reduction in CO², as well as the demands of the Enquete Commission of the German Bundestag for more environmentally compatible development and preservation of forests, are to be supported. The creation of drinking-water forests, with their ecological and economic effects, is to be accompanied scientifically and its significance conveyed to the public in an appropriate form.

In order for us to carry out this task, we process personal data about you. Data protection is a matter of trust, and with this notice we would like to explain transparently how we process personal data when you visit our website. In doing so, we are in particular complying with our obligations under the General Data Protection Regulation (GDPR), the Federal Data Protection Act (BDSG), the Hamburg Data Protection Act (HmbDSG) and the Telecommunications and Telemedia Data Protection Act (TTDSG).

If you have any questions, we would be pleased if you contact us.

(For better readability, the data protection information uses the generic masculine form. Unless otherwise indicated, the personal designations used refer to all genders.)

II. Data processing by Trinkwasserwald e.V.

1. Who is responsible for the data processing?

The Trinkwasserwald e.V. is responsible for data processing within the meaning of the GDPR. You can reach us using the following contact details:

2. For what purpose and on what legal basis are your personal data processed?

We process your personal data, such as inventory data, payment data, contact data, contract data, usage data, IP address or other information linked to your identity, on the basis of Article 6 GDPR to safeguard our legitimate interest in fulfilling our statutory task or due to a legal obligation (Article 6(1)©), to provide a functioning website and our content and services (Article 6(1)(f), if applicable Article 6(1)(a) GDPR, Section 25 TTDSG), to fulfil a contractual agreement with you (Article 6(1)(b)), to respond to contact enquiries (Article 6(1)(b)) or insofar as you have given your consent (Article 6(1)(a)).

3. How long will your data be stored?

We delete your data as soon as the purpose of storage no longer applies. The data you send us for enquiries will remain with us until you request deletion, withdraw your consent to storage or the purpose for data storage no longer applies (e.g. after your request has been fully processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

4. What rights do you have?

Subject to any statutory restrictions, you have the following rights, which you may exercise: the right of access, rectification, erasure, restriction of processing, data portability and objection. Details can be found in Articles 15 to 21 and 77 of the GDPR.

* Right of access (Article 15 GDPR)

Under the conditions of Article 15 GDPR, you may request information from the controller about your personal data processed by us. In your request for information, you should specify your concern to make it easier to compile the necessary data.

* Right to rectification (Article 16 GDPR)

If the information concerning you is no longer correct, you may request rectification without delay. If your data is incomplete, you may request completion, taking into account the purposes of the processing.

* Right to erasure / „right to be forgotten“ (Article 17 GDPR)

Under the conditions of Article 17 GDPR, you may request the erasure of your personal data. Whether you can request the immediate erasure of your personal data depends, among other things, on whether the data concerning you is still required to fulfil statutory or contractual obligations.

* Right to restriction of processing (Article 18 GDPR)

Under certain conditions, you have the right to request a restriction of the processing of the data concerning you.

* Right to data portability (Article 20 GDPR)

Please let us know in writing which data you would like transferred and to whom. We will review your request promptly and inform you of the result.

* Right to object (Article 21 GDPR)

Under the conditions of Art. 21 GDPR, you have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you. However, this may not be possible if the controller can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing serves the establishment, exercise or defence of legal claims.

* Right to lodge a complaint (Article 77 GDPR)

If you believe that the processing of the personal data concerning you infringes the GDPR, you may lodge a complaint with the competent data protection supervisory authority. This is the Hamburg Commissioner for Data Protection and Freedom of Information.

The relevant contact details of the Hamburg Commissioner for Data Protection and Freedom of Information are as follows:

The Hamburg Commissioner for Data Protection and Freedom of Information, Ludwig-Erhard-Str. 22, 20459 Hamburg (Tel.: 040/42854 – 4040, E‑Fax: 040/4279 – 11811, E‑Mail: mailbox@datenschutz.hamburg.de)

III. Collection and processing of personal data when visiting this website

1. General information on data processing on the website

When you visit our website, we store your IP address (via the network provider); in addition, further data (analysis data, log data, usage data) is transmitted by the browser and stored by our web server. This includes, among other things, information about the end device, time of access, the origin of the request, browser and version, use of our site and, where applicable, whether you have visited us before.

This serves the technically error-free presentation and optimisation of the website, information security and evaluations based on Art. 6 para. 1 lit. f GDPR (legitimate interest in our online presence and IT security). Where consent has been obtained, data processing is carried out on the basis of Art. 6 para. 1 lit. a GDPR and § 25 TTDSG. Consent can be withdrawn at any time. No data is transferred to third countries.

2. Contact and correspondence

On our website, we provide you with the email addresses and telephone numbers of the contact persons for direct contact. Alternatively, you can also reach us via the contact form and by post. If you contact us, the personal data you provide will be stored and used for further correspondence. This serves communication, public relations, revenue generation, documentation and evaluations on the basis of Art. 6 para. 1 lit. b GDPR (initiation / performance of a contract), Art. 6 para. 1 lit. f GDPR (legitimate interest in communication). No data is transferred to third countries.

3. Press area

In our press area on the website, we offer information and press reports for download. This serves marketing, public relations and analyses on the basis of Art. 6(1)(b) GDPR (initiation / performance of a contract). No data are transferred to a third country here either.

4. Donation page

On the website, we offer the option of arranging one-off or recurring donations to support our charitable work. To commission and process a donation transaction, the website uses the betterplace.org plugin. The contact and payment data you provide to us are processed within the framework of the statutory provisions and for the selected payment method, as well as for issuing a donation receipt. No data are transferred to a third country.

5. SSL encryption

For security reasons and to protect the transmission of confidential content, such as enquiries you send to us as the website operator, our website uses SSL encryption. You can recognise an encrypted connection by the fact that the browser address bar changes from „http://“ to „https://“ and by the padlock symbol in your browser bar.

When SSL encryption is activated, the data you transmit to us cannot be read by third parties.

6. Tracking tools (cookies)

To provide our web offering optimally, we also use cookies, among other things. Cookies can perform different tasks, including adapting the website to your screen and browser and language settings. In addition, the term „cookie“ is used as a synonym for tracking tools. Tracking tools help us to adapt our website even better to your needs.

In order to be able to use cookies, third parties and content in compliance with data protection regulations, we use a so-called cookie tool to query your preferences. This tool divides the providers used into three categories (necessary, statistics, third parties and content). This categorisation also forms the basis for the purposes and legal grounds.

Necessary: Necessary cookies help make a website usable by enabling basic functions like page navigation and access to secure areas of the website. The website cannot function properly without these cookies.

Statistics: These cookies help website owners understand how visitors interact with websites by collecting and reporting information anonymously.

Third-party providers and content: These cookies are used on the one hand by providers of third-party content, such as video portals, podcast or social media platforms, to deliver their services, and on the other hand by third parties to provide services, e.g. Google Maps.

The cookies are used for the following purposes:

Necessary: Control of cookie settings

Statistics: Improvement of usability, analysis of user behaviour, analysis of technical parameters, adaptation of the offer to the user’s usage behaviour

Third-party providers and content: Optimisation of processes, personalisation, connection to selected social media channels

Data processing by cookies is carried out on the following legal bases:

Necessary: We process the data on the basis of Art. 6 para. 1 lit. f GDPR, the legitimate interest. Our interest lies in providing you with a technically functioning website, adapted to your end device and written in a language you understand.

You have the right, for reasons arising from your particular situation, to object to this processing at any time. Further information can be found under Rights of data subjects.

Statistics, third-party providers and content: We process this data on the basis of your consent pursuant to Art. 6 para. 1 lit. a GDPR, which you can give us via our [borlabs-cookie type=“btn-consent-preferences“ title=“Cookie-Tool“ element=“link“/].

[borlabs-cookie type=“btn-consent-preferences“ title=“Cookie settings“/]

This consent is voluntary and can be withdrawn by you at any time with effect for the future. You can withdraw your consent by reopening the cookie tool (see below) and changing the settings accordingly to your wishes. Further information on your right of withdrawal can be found under section II, item 4 „What rights do you have?“.

7. Data sharing

Personal data will not be transferred to third parties for reasons other than those listed below.

This only takes place if

• you have expressly given us your consent for the underlying processing,

• this is legally permitted and necessary for the execution of our contractual relationships with you,

• the disclosure of the data is based on a legal obligation, or if

• the disclosure of the data is based on a legitimate interest and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data.

Joint controllership

As part of our service, we work with partners in selected areas in such a way that, in accordance with the GDPR, this constitutes joint controllership pursuant to Art. 26 GDPR. These companies take over part of the data processing and receive the data they require from us for this purpose. This may also include personal data. Under the GDPR, both companies are then responsible for this processing or for the legally compliant handling of your data.

These include the following partners: Facebook, Instagram.

Possible recipients of personal data

We disclose data, within the scope of what is legally permissible, to the following recipients or categories of recipients: employees (internal and external), providers of analytics tools, IT infrastructure service providers, software service providers, other service providers, social media providers, cooperation partners, funding companies and authorities.

International data transfer

We make every effort to rely only on service providers that guarantee the processing of personal data within the European Union. In individual cases, however, this is not possible.

These partners operate in various countries outside the European Union or the European Economic Area (EEA). In these countries, the same level of data protection is not always legally prescribed and established as in the European Union. For this reason, we have taken a number of measures in accordance with the GDPR to ensure the highest possible protection of your personal data.

These are:

– Cooperation with companies in a country that has been recognised by an adequacy decision of the European Commission

– Cooperation with companies on the basis of the EU Standard Contractual Clauses

– In addition, in special cases there is the possibility of transferring the data on the basis of your explicit consent.

We ensure that our partners guarantee the implementation of the measures within the framework of the legal requirements.

8. Protection of your data

To protect your personal data, we have taken measures that comply with data protection law and the state of the art in our industry. These are continuously reviewed and adapted where necessary. The aim is to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorised access by third parties.

We protect the systems and processing through a range of technical and organisational measures. These include, among other things, data encryption, pseudonymisation and anonymisation, logical and physical access restrictions and controls, firewalls and recovery systems, and integrity tests.

Our employees are regularly trained in the appropriate sensitive handling of personal data and, in accordance with legal requirements, are obliged to observe data confidentiality.

9. Inclusion of third-party providers

If you or we use services from third-party providers, personal data will be transmitted to them.

a) Analytics tools and advertising

• Google Tag Manager

We use Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Tag Manager is a tool that allows us to integrate tracking or statistics tools and other technologies into our website. Google Tag Manager itself does not create user profiles, store cookies or perform independent analyses. It serves solely to manage and deploy the tools integrated through it. However, Google Tag Manager collects your IP address, which may also be transferred to Google’s parent company in the United States.

• Google Analytics

This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyse the behaviour of website visitors. In doing so, the website operator receives various usage data, such as page views, length of stay, operating systems used and the user’s origin. This data is assigned to the respective end device of the user. It is not assigned to a user ID.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analysing user behaviour (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is usually transferred to a Google server in the USA and stored there.

The data transfer to the USA is based on the EU Commission’s standard contractual clauses. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.

• Google Maps

This website uses the Google Maps map service. The provider is Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.

To use the features of Google Maps, it is necessary to save your IP address. This information is generally transmitted to a Google server in the USA and stored there. The provider of this site has no control over this data transfer. If Google Maps is activated, Google may use Google Web Fonts for the purpose of the uniform display of fonts. When Google Maps is accessed, your browser loads the required Web Fonts into its browser cache in order to display text and fonts correctly.

Data transfer to the USA is based on the EU Commission’s standard contractual clauses. Details can be found here: https://privacy.google.com/businesses/gdprcontrollerterms/ and https://privacy.google.com/businesses/gdprcontrollerterms/sccs/.

For more information on how user data is handled, please see Google’s privacy policy: https://policies.google.com/privacy?hl=de.

• IP anonymisation

We have activated the IP anonymisation function on this website. As a result, your IP address is shortened by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide further services associated with website and Internet use to the website operator. The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data.

• Browser plugin

You can prevent Google from collecting and processing your data by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

For more information on how user data is handled in Google Analytics, please see Google’s privacy policy: https://support.google.com/analytics/answer/6004245?hl=de.

• Contract processing

We have entered into a data processing agreement with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

• Google Ads

The website operator uses Google Ads. Google Ads is an online advertising programme of Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Ads enables us to display advertisements in the Google search engine or on third-party websites when the user enters certain search terms on Google (keyword targeting). Furthermore, targeted advertisements can be displayed on the basis of user data available to Google (e.g. location data and interests) (audience targeting). As website operators, we can evaluate this data quantitatively by, for example, analysing which search terms led to the display of our advertisements and how many ads resulted in corresponding clicks.

Data transfer to the USA is based on the EU Commission’s standard contractual clauses. Details can be found here: https://policies.google.com/privacy/frameworks and https://privacy.google.com/businesses/controllerterms/mccs/.

• Google Conversion Tracking

This website uses Google Conversion Tracking. The provider is Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.

With the help of Google Conversion Tracking, Google and we can recognise whether the user has carried out certain actions. For example, we can analyse which buttons on our website were clicked how often and which products were viewed or purchased particularly frequently. This information is used to create conversion statistics. We learn the total number of users who clicked on our ads and which actions they carried out. We do not receive any information that would allow us to personally identify the user. Google itself uses cookies or similar recognition technologies for identification.

For more information on Google Conversion Tracking, please see Google’s privacy policy: https://policies.google.com/privacy?hl=de.

Further information can be found in Instagram’s privacy policy.

• Privacy policy for the use of Twitter

Our websites include functions of the Twitter service. These functions are offered by Twitter Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA. By using Twitter and the „Re-Tweet“ function, the websites you visit are linked to your Twitter account and made known to other users. Data is also transmitted to Twitter. • Privacy policy when using LinkedIn

This website uses elements of the LinkedIn network. The provider of these functions is LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland.

Each time a page on this website containing LinkedIn elements is accessed, a connection is established to LinkedIn servers. LinkedIn is informed that you have visited this website using your IP address. If you click the „Recommend“ button from LinkedIn and are logged into your LinkedIn account, LinkedIn is able to assign your visit to this website to you and your user account. We would like to point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or of its use by LinkedIn.

Further information can be found in LinkedIn’s privacy policy at: https://www.linkedin.com/legal/privacy-policy.

c) further plugins and tools

• betterplace.org plugin

Our website uses the betterplace.org plugin. This is a service operated by gut.org gemeinnützige Aktiengesellschaft, Schlesische Straße 26, 10997 Berlin.

The information you enter in the donation input form is transmitted to betterplace.org by clicking the „Donate now!“ button and processed for handling your donation via the chosen payment method and for issuing a donation receipt.

Further information on the handling of personal data in connection with the betterplace.org plugin can be found in the privacy policy of betterplace.org at: https://www.betterplace.org/c/regeln/datenschutz

• YouTube with enhanced privacy mode

This website embeds videos from YouTube. The operator of these pages is Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in enhanced privacy mode. According to YouTube, this mode means

YouTube does not store any information about visitors to this website before they watch the video. However, the transfer of data to YouTube partners is not necessarily excluded by the enhanced privacy mode. YouTube also establishes a connection to the Google DoubleClick network – regardless of whether you watch a video.

As soon as you start a YouTube video on this website, a connection is established to YouTube’s servers. This tells the YouTube server which of our pages you have visited. If you are logged into your YouTube account, you allow YouTube to assign your browsing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account.

In addition, after starting a video, YouTube may store various cookies on your device or use similar recognition technologies (e.g. device fingerprinting). In this way, YouTube can obtain information about visitors to this website. This information is used, among other things, to record video statistics, improve user-friendliness and prevent attempts at fraud.

If applicable, further data processing operations may be triggered after a YouTube video is started, over which we have no control.

Further information on data protection at YouTube can be found in their privacy policy at: https://policies.google.com/privacy?hl=de.

• Google Web Fonts

This website uses so-called web fonts provided by Google for the uniform display of fonts. When a page is called up, your browser loads the required web fonts into its browser cache in order to display texts and fonts correctly.

For this purpose, the browser you use must connect to Google’s servers. As a result, Google becomes aware that this website was accessed via your IP address. If your browser does not support web fonts, a standard font from your computer will be used.

Further information on Google Web Fonts can be found at https://developers.google.com/fonts/faq and in Google’s privacy policy: https://policies.google.com/privacy?hl=de.

• Google reCAPTCHA

We use „Google reCAPTCHA“ (hereinafter „reCAPTCHA“) on this website. The provider is Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.

reCAPTCHA is used to check whether data entry on this website (e.g. in a contact form) is carried out by a human or by an automated programme. For this purpose, reCAPTCHA analyses the behaviour of website visitors based on various characteristics. This analysis starts automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various pieces of information (e.g. IP address, length of time the website visitor stays on the website or mouse movements made by the user). The data collected during the analysis is forwarded to Google.

The reCAPTCHA analyses run completely in the background. Website visitors are not informed that an analysis is taking place.

For more information about Google reCAPTCHA, please refer to Google’s privacy policy and terms of use at the following links: https://policies.google.com/privacy?hl=de and https://policies.google.com/terms?hl=de.

• Adobe Fonts

This website uses web fonts from Adobe for the uniform display of certain typefaces. The provider is Adobe Systems Incorporated, 345 Park Avenue, San Jose, CA 95110–2704, USA (Adobe).

When you access this website, your browser loads the required fonts directly from Adobe so that they can be displayed correctly on your device. In doing so, your browser establishes a connection to Adobe’s servers in the USA. As a result, Adobe becomes aware that this website was accessed via your IP address. According to Adobe, no cookies are stored when the fonts are provided.

The transfer of data to the USA is based on the EU Commission’s standard contractual clauses. You can find details here: https://www.adobe.com/de/privacy/eudatatransfers.html.

You can find more information about Adobe Fonts here: https://www.adobe.com/de/privacy/policies/adobe-fonts.html.
